Terms and Conditions
These Terms govern access to the private FunDesign Artists Portal operated by Artmu Oy. The Portal is an administrative service for invited and approved members, artists, vendors, and their authorised representatives. It is not an online shop, and consumer purchases are not made through it.
1. Service provider
Artmu Oy
Servinkuja 6 B 007, 02150 Espoo, Finland
Business ID: 3322952-2
VAT number: FI33229522
Email: info@fundesign.fi
2. Eligibility and accounts
The Portal is intended only for adults whom Artmu Oy works with or is considering for membership. Individuals, sole traders, and authorised representatives of companies may register. Registration does not create a right to membership, vendor status, FUN+, or access to all features. Artmu Oy reviews accounts and may approve or decline them.
You must provide accurate information, keep it current, protect your login credentials, and notify us promptly if you suspect unauthorised use. If you act for a brand, company, artist group, or other person, you confirm that you are authorised to do so. Accounts may not be transferred or shared without our permission.
3. Relationship to separate agreements
These Terms govern use of the Portal only. Membership, FUN+, vendor participation, resale arrangements, commissions, invoicing, payment dates, events, and other commercial matters may be governed by a separate signed agreement or specific terms. Accepting these Terms does not itself make you a vendor, conclude a sales agreement, or replace those documents. If a separate written agreement conflicts with these Terms, that agreement controls the conflicting commercial matter.
4. Portal functions and data
Depending on your role and status, the Portal may be used to maintain profiles, products, inventory, membership cards, sales reports, payout information, and related administrative records. Physical shops and events are represented as locations. Product information may be exported to a separate shop system, and sales information may be imported back into the Portal.
Sales, inventory, payout, and import figures are administrative records and may contain matching, reporting, import, or human errors. Review information relevant to you and contact us promptly about a suspected error. Final commercial rights and obligations are determined under the applicable separate agreement and accounting records, not solely by what is displayed in the Portal.
5. Products and lawful content
You are responsible for information and content you submit. It must be accurate, lawful, safe for its intended use, and not misleading. You must have all rights and permissions needed for names, descriptions, designs, links, and other material. Infringing, counterfeit, unlawful, or unauthorised copyrighted content is not permitted. Product approval in the Portal is not legal, regulatory, or safety certification.
You retain ownership of your content. You grant Artmu Oy a non-exclusive right to store, reproduce, format, review, and use it as reasonably necessary to operate the Portal and administer the relevant membership, shop, event, or vendor relationship. Wider promotional use is handled separately unless otherwise agreed.
6. Membership cards
A membership photo is required for a card to be operational. The photo must show you and may not impersonate another person. You may remove or replace the photo stored in the Portal. Removing it does not remove copies of a card already downloaded or saved on a device; you are responsible for those copies. A card does not establish any entitlement beyond the applicable membership arrangement.
7. Acceptable use
You must not access another person's data, bypass access controls, probe or disrupt security, upload malicious material, scrape the Portal, misuse exports, or use the service unlawfully. You must not submit personal data about customers or other third parties unless the Portal expressly requests it and you have a lawful basis.
8. Availability and account restrictions
The Portal is provided as an administrative tool and may change. We do not promise uninterrupted or error-free availability. We may suspend or restrict access for security, maintenance, suspected misuse, inactivity, loss of eligibility, termination of the relevant relationship, or legal and operational reasons. Where reasonably possible, we will explain a restriction or provide notice.
9. Liability
Artmu Oy will use reasonable care in operating the Portal. To the fullest extent permitted by applicable law, Artmu Oy is not liable for indirect or consequential loss, loss of profit or opportunity, inaccurate source data supplied by others, or interruptions and loss caused by matters outside its reasonable control. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits rights that mandatory law gives you.
10. Privacy
Personal data is handled as described in the Privacy Policy and Cookie Policy.
11. Changes to these Terms
We may update these Terms when the Portal, law, security needs, or our operating practices change. We will identify the current version on this page. Material changes that affect your rights or obligations will require renewed acceptance before you continue using restricted Portal features. For non-material changes, such as clarifications, corrections, or contact-detail updates, we may provide a notice without requiring renewed acceptance.
12. Language, law, and disputes
These Terms are provided in English, and the English version prevails. Finnish law applies. If a dispute arises, contact us first so the parties can attempt to resolve it through negotiation. If no settlement is reached, the dispute will be submitted to the Länsi-Uusimaa District Court, unless mandatory law requires another forum.
